ONE-ON-ONE COACHING AND MENTORING TERMS AND CONDITIONS

Program Investment

The coaching and mentoring package is $15,000 AUD (including GST).

The package includes up to thirteen (13) mentoring sessions, reasonable email support, and ad hoc "laser mentoring" support as determined by Broker Essentials during the agreed coaching term.

The coaching package must be completed within twelve (12) months of commencement unless otherwise agreed in writing.

Mentoring Procedure

Sessions will generally be conducted via Zoom, Microsoft Teams, FaceTime, telephone or another agreed platform.

Session duration and frequency will be determined by mutual agreement between the client and Broker Essentials.

Payment

Payment must be made in advance in accordance with the agreed payment schedule.

Where payment is made by instalments, all instalments must be paid when due.

Broker Essentials reserves the right to suspend coaching sessions, mentoring support, access to resources and any associated services where payments are overdue.

Any payment outstanding for more than 30 days may result in the suspension or termination of services.

Termination of services due to non-payment does not waive any outstanding amounts owed under this agreement.

Coaching Disclaimer

Coaching, mentoring and consulting services are educational and developmental in nature.

They are not psychological counselling, therapy, medical treatment, legal advice, accounting advice, taxation advice, financial advice or any other regulated professional service.

The effectiveness of coaching depends on numerous factors, including the client's commitment, implementation, effort, market conditions, experience and circumstances.

Broker Essentials makes no representation or guarantee regarding specific business, financial, operational or personal outcomes.

Confidentiality

Broker Essentials respects the confidentiality of all clients.

Information disclosed during coaching sessions, mentoring discussions, workshops, emails, messages or other communications will be treated as confidential unless disclosure is required by law.

Broker Essentials may use de-identified observations, themes, case studies and learnings for educational, training or promotional purposes, provided no personally identifiable information is disclosed.

Session Changes and Cancellations

Sessions may be rescheduled with a minimum of 24 hours' notice.

Sessions cancelled with less than 24 hours' notice, or missed without notice, will be deemed delivered and deducted from the client's session allocation.

Exceptions may be made at the sole discretion of Broker Essentials in cases of genuine emergency.

Outstanding Sessions

Any unused sessions that have not been scheduled within three (3) months of the previous coaching session may be forfeited.

All coaching sessions must be completed within twelve (12) months of commencement unless otherwise agreed in writing.

Program Cancellation

Clients may terminate their participation in the coaching program by providing written notice.

Any fees paid are non-refundable unless otherwise required by law.

At the sole discretion of Broker Essentials, a credit may be issued for any unused portion of the program. Any such credit will be valid for twelve (12) months from the date of issue and may only be transferred with prior written approval.

Broker Essentials reserves the right to immediately terminate the coaching relationship where unlawful, unethical, abusive, threatening or inappropriate conduct is identified.

Where Broker Essentials terminates the agreement for reasons unrelated to client conduct, a refund or credit may be provided for any unused coaching sessions.

Intellectual Property

All coaching materials, frameworks, templates, tools, systems, documents, recordings, resources and content provided by Broker Essentials remain the intellectual property of Broker Essentials unless otherwise stated.

Clients are granted a non-transferable licence to use these materials within their own business.

Materials may not be reproduced, distributed, shared, sold, licensed or provided to any third party without prior written consent.

Client Responsibility

The client remains solely responsible for all business, financial, operational, staffing, marketing, compliance and strategic decisions made during or following participation in the coaching program.

Broker Essentials provides mentoring, coaching, education, guidance and recommendations only.

All decisions and actions taken by the client remain the client's sole responsibility.

Limitation of Liability

Participation in coaching and mentoring may involve discussion of challenging business, personal or professional matters.

The client acknowledges that coaching may at times result in feelings of frustration, uncertainty, stress or discomfort.

To the maximum extent permitted by law, Broker Essentials excludes all liability for any direct or indirect loss, damage, cost, expense, business interruption, loss of revenue, loss of profit, loss of opportunity or consequential loss arising from participation in the coaching program.

Participation is voluntary and undertaken entirely at the client's own risk.

Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia.
